Important Time Frames in an Oil Spill Claim
There are a number of important dates and time periods to watch when making a BP oil spill claim. Failure to file necessary paperwork within certain time frames can result in a denial of your claim.
Baseline Eligibility to File an Oil Spill Claim
For a person to be eligible for a claim under the Oil Pollution Act (OPA) the incident for which the claim is being filed must have occurred on or after August 18th, 1990. For all modern claims this will not be an issue, and barring extenuating circumstances any cases prior to that time would not be eligible for other reasons.
Deadlines for Filing an Oil Spill Claim
Filing an oil spill claim for damages or loss of income must be made within 3 years of the time the damages occurred and were reasonably discoverable. For oil spill claims relating to cleanup and oil removal, all claims must be made within 6 years of the completion of the cleanup.
Submitting Additional Information
Once an oil spill claim has been filed with the National Pollution Funds Center, they may ask for additional information to complete their deliberations. From the time this request is made, you will have 90 days to submit the requested information. Failure to do so will result in the NPFC making a judgment based on the incomplete information.
Accepting or Rejecting a Determination
Once a determination has been made as to the compensation you are eligible for, you have 60 days to either accept or reject it. Failure to act within that 60 days will result in a voiding of the offer of compensation, and closure of the claim.
